Who Has Your Back? Government Data Requests 2015 We live digital lives—from the videos shared on social networks, to location-aware apps on mobile phones, to log-in data for connecting to our email, to our stored documents, to our search history. The personal, the profound, and even the absurd are all transcribed into data packets, whizzing through the fiber-optic arteries of the network. While our daily lives have upgraded to the 21st century, the law hasn’t kept pace. To date, the U.S. Congress hasn’t managed to update the 1986 Electronic Communications Privacy Act to acknowledge that email stored more than 6 months deserves identical protections to email stored less than 6 months. Congress also dragged its feet on halting the NSA’s indiscriminate surveillance of online communications and has yet to enact the strong reforms we deserve. Congress is even on the precipice of making things far worse, considering proposals that would mandate government backdoors into the technology we...

Assessing the Draft Cyber Executive Order
Assessing the Draft Cyber Executive Order Amidst the whirlwind of executive orders and presidential memoranda that have been in the news, it was easy to miss a purported draft of President Trump’s first executive order (EO) covering cybersecurity issues, leaked to the Washington Post and released on Friday, January 27. The order, titled “Strengthening U.S. Cyber Security and Capabilities,” calls for several 60- and 100-day assessments of the state of U.S. cybersecurity and the identification of areas of improvement. This mirrors the approach taken by President Obama, who ordered his own 60-day cyberspace review shortly after assuming office. Our bottom line up front, assuming the text of this draft does not change, is that while the intent of the executive order represents a reasonable start to getting a handle on the cybersecurity challenges that await this administration, this appears to be another case where an executive order has not been coordinated with federal departments and...

This Is the Guy Who Started the #DeleteUber Protest On Saturday night, Uber’s New York City Twitter account announced that it was turning off surge pricing for trips at JFK airport in light of the protests against Donald Trump’s executive order that bans immigrants from seven Muslim-majority countries. Shortly after, Dan O’Sullivan became the first to tweet #DeleteUber—a hashtag that quickly became a top-trending topic on Twitter and the No.1 trend in the country that same night. After the New York Taxi Workers Alliance called for a one-hour work stoppage in solidarity with the protests, Uber announced it was turning off its surge pricing. But Sullivan (who goes by the twitter handle @Bro_Pair), and what is now thousands of others, swiftly accused the ride-sharing company of trying to profit from the work stoppage by taxi drivers.
